Shariah Portfolio Structuring: Document the Governance
Decision in brief
A family mandate needs a process that continues when a manager changes or the principal cannot attend a meeting. Document who sets the religious policy, who selects investments, who monitors compliance and who authorises action when an issue appears.
A methodology is part of governance
MSCI describes independent Sharia advisory committee approval of its Islamic index methodology. That is product-specific evidence; it should not be presented as approval of an unrelated personal portfolio.

Write a responsibility map
| Responsibility | Decision to record |
|---|---|
| Policy | Which standard is accepted and who can change it? |
| Investment | Who approves the mandate and its financial limits? |
| Screening | Who supplies the evidence and resolves conflicting results? |
| Exceptions | Who decides on disposal, retention or further review? |
| Reporting | Which records reach the principal and family representatives? |
Test the process with a real question
Choose an existing holding and ask the provider to show the chain from company evidence to the chosen methodology, the conclusion and any required follow-up. The purpose is to understand the service, not to accept a sample as a ruling on every holding.
- Keep methodology versions and review dates with the decision record.
- Specify what happens when filings are late or data providers disagree.
- Agree who handles any purification calculation and communication.
- Separate financial suitability from the religious conclusion.
- Define the work retained by existing advisers and the gap a new specialist would cover.
When a separate structure may not be needed
If the problem is incomplete records or unclear responsibility, improve those first. Establishing an entity does not by itself create a screening process. Legal ownership, tax treatment and succession should be reviewed for the actual family circumstances, with clear professional responsibility for each.
